PRESIDENTIAL EMERGENCY BOARD NO. 252 ISSUES A REPORT ON NEW JERSEY TRANSIT RAIL OPERATIONS / BROTHERHOOD OF LOCOMOTIVE ENGINEERS AND TRAINMEN DISPUTE
Washington, D.C. – Executive Order No. 14128 issued on November 21, 2024, established a second Presidential Emergency Board (PEB) to investigate a collective bargaining dispute between New Jersey Transit Rail Operations and their Locomotive Engineers represented by the Brotherhood of Locomotive Engineers and Trainmen. A second PEB in this dispute is allowed under Section 9(a) of the Railway Labor Act.
On January 20, 2025, following its investigation, the PEB submitted its Report to the President, which is available on the NMB Website (nmb.gov). No work stoppages, and no changes in the conditions out of which the disputes arose (except by agreement of the parties), are permissible for 60 days following the submission of the Report.

The National Mediation Board (NMB) is an independent agency created by the Railway Labor Act, which governs labor management relations in the railroad and airline industries. To avoid serious disruptions to the Nation’s economy and protect the public interest, the Act imposes on carriers and their employees the duty of settling disputes through negotiation, mediation, and arbitration. The NMB, headed by three Presidential appointees, has as its chief statutory responsibilities: (1) mediation of collective bargaining disputes; (2) determination of employee representation for collective bargaining processes; and (3) administration of a grievance arbitration system.
